Court shuts door on Fidesz before even opening the case
The Constitutional Court (Ab) rejected the Fidesz-KDNP submissions against the Basic Law amendments at its Monday session. In all three cases, the Ab cited primarily a lack of jurisdiction, and therefore did not examine the motions on their merits.
The Constitutional Court ruled that Tufan İlbaş's freedom of expression was violated when he was not allowed to give a yellow, red, and green bracelet he made in prison to his visitor. The court ordered that İlbaş be paid 20,000 Turkish lira in compensation for moral damages and that the case be sent back to the Tekirdağ 2nd Enforcement Court for retrial.
Omnibus bills passed by the Parliament with a majority vote of the AK Party-MHP coalition have caused the Supreme Court to work overtime. In the first half of 2026, 71 provisions of laws or decrees that were brought before the Constitutional Court on the grounds of "unconstitutionality" were annulled.
