- On Monday, Texas Attorney General Ken Paxton released his "Texas First Data Center Plan," proposing to ban Chinese technology from data centers and hold companies criminally liable for AI chatbots endangering children.
- Democratic Texas State Rep. James Talarico unveiled his "Hold Data Centers Accountable Plan" in July, arguing that existing tax incentives have flooded Texas with facilities against voter wishes in rural communities.
- Texas currently hosts 335 existing data centers with more than 248 in development, while a 2013 sales tax exemption that Paxton supported as a freshman state senator is projected to cost $3.2 billion over two years.
- Critics, including Talarico, questioned the plan's sincerity after discovering a "made with AI" disclaimer on Paxton's social media post, with Talarico calling it a "sad attempt to reverse course."
