A court in Nice has suspended the burkini ban in a Côte d'Azur town by failing to assess sufficient grounds for maintaining the measure.
Close to David Lisnard, the mayor of Mandelieu-la-Napoule, Sébastien Leroy, had already issued municipal decrees prohibiting burkini on the beaches in the summers of 2023, 2024 and 2025. Illegal decisions, each time suspended by the administrative court of Nice.
There is no evidence of disturbance of public order.
In France, some coastal towns impose Burkini bans on the beach, although France's Supreme Administrative Court overturned such a ban years ago.
Years ago, France's Supreme Administrative Court voted against a Burkini ban. A coastal town resisted and did not allow full-body bathing suits. Now the regulation has been repealed.
Sebastien Leroy, the editor of Mandelieu-la-Napoule, had by decree prohibited access to the beaches to persons wearing this garment. A decision which the judge of the interim proceedings did not consider justified.
