Firm Calls for Investigation of 16 Minnesota School Districts over 'Sexual Identity Policies'
The Upper Midwest Law Center says the districts’ policies violate Title IX and parental rights by allowing boys in girls’ sports and social transitions.
The Upper Midwest Law Center announced Wednesday it asked the U.S. Department of Education's Office for Civil Rights to investigate 16 Minnesota school districts, alleging their sexual identity policies violate Title IX and the U.S. Constitution.
Brent Robbins, senior counsel for religious liberty at the law center, said districts are ignoring Supreme Court guidance by allowing biological boys in girls' sports and facilities while permitting student social transitions without parental notice.
The group argues Minnesota Attorney General Keith Ellison's February 2025 letter to the Minnesota State High School League created confusion by encouraging schools to continue allowing biological males in girls' sports despite federal executive orders.
Moorhead Area Public Schools stated it remains in full compliance with all applicable laws and has received no complaint, while Rochester Public Schools said its team is reviewing the information before responding.
The law firm requested that federal officials take enforcement action if necessary to bring districts into compliance, contending that Title IX protects women and girls and school districts cannot erase these protections through internal policies.
