A 13-year-old boy named Clayton Phillips died after falling from a Yo-Yo carnival ride in Butte, Montana, in June while the ride was moving at full speed.
The lawsuit alleges that at least 10 chairs on the ride had visible safety deficiencies, including missing restraint components, which were not properly addressed.
The suit claims that improperly trained employees allowed Clayton to ride in a chair without proper restraints, or that the restraints failed.
Clayton's family is suing multiple parties including the city-county government, Midway West Amusements, and the inspection company, seeking compensatory and punitive damages related to the incident.
