Watchdog says Biden Education Department defied court order on Title IX enforcement
Empower Oversight says the department pursued gender identity and sexual orientation complaints in states covered by a federal injunction, despite a 2022 court order.
Empower Oversight alleges the Biden Department ignored a federal court injunction by continuing Title IX investigations into gender identity and sexual orientation complaints in multiple states.
A Tennessee federal judge blocked the Biden Department in July 2022 from enforcing guidance that expanded Title protections to include gender identity and sexual orientation.
Investigations in Oklahoma and Georgia, specifically involving Owasso Public Schools and Forsyth County Schools, continued despite the injunction, according to Empower Oversight disclosures.
Empower Oversight filed whistleblower disclosures with the Office of Special Counsel alleging the Department's December 2024 report omitted material facts and contained misleading statements.
Tristan Leavitt, president of Empower Oversight, urged the Department to finalize and release the report after the Office of Special Counsel requested a supplemental response by March 12, 2025.
