US Launches Section 301 Probe Into Germany over Drug Pricing
The probe could lead to tariffs as the United States says Germany’s pricing policies leave American patients and taxpayers paying more for drug innovation.
On Thursday, the United States launched a Section 301 investigation into Germany over what it called "persistent underpayment for innovative pharmaceutical products," setting the stage for possible new tariffs.
President Trump's administration alleges German pricing policies restrict commerce and force Americans to shoulder a "disproportionate share of global pharmaceutical research and development" costs. Germany is fast-tracking legislation to reduce drug spending.
Stephen Ubl, president of the Pharmaceutical Research and Manufacturers of America, said his organization "appreciates the administration's commitment to challenging unfair practices abroad" and supports using Section 301 to achieve this goal.
Trade Representative Jamieson Greer suggested the dispute could be resolved through negotiations, pointing to a US-UK deal from earlier this year as a potential model. The White House and German Embassy did not immediately respond.
Trump has increasingly used trade probes to impose duties after the Supreme Court struck down many sweeping tariffs in February. The administration recently proposed up to 12.5 percent tariffs on dozens of economies under similar investigations.
