US judge orders four states be given access to citizenship data for voter checks
The ruling restores bulk-upload and Social Security number search tools after the judge said DHS violated a settlement with four Republican-led states.
- On Tuesday, District Judge Kent Wetherell ordered DHS to immediately reinstate bulk-upload and Social Security number search features in the SAVE database for Florida, Indiana, Ohio, and Iowa after the four states sought enforcement of a November 2025 settlement.
- This ruling conflicts with an order last month from Judge Sooknanan, who blocked the expanded SAVE system after determining it ignored privacy laws and violated the Constitution while verifying the citizenship status of more than 67 million voters.
- Wetherell wrote that the agency was "plainly in violation" of the settlement agreement, stating, "This Court is not bound by Judge Sooknanan's order, and with all due respect, the Court disagrees with the conclusions in that order."
- DHS now faces two contradictory court orders, leaving the agency in a bind as it must decide whether to comply with the Florida mandate or maintain the block imposed by the Washington court.
- The League and EPIC, which filed an amicus brief in the Florida case, will likely appeal Tuesday's decision to the 11th Circuit Court of Appeals, as the Trump administration continues to challenge Sooknanan's ruling in the D.C. Circuit Court.
