US Court Reverses NJ permit for Williams NESE Natural Gas Pipeline
The ruling sends the certification back to state regulators after judges said Williams failed to show the pipeline would meet water-quality standards.
- On Tuesday, a federal appeals panel vacated a key water quality certification for the $1 billion Northeast Supply Enhancement natural gas pipeline, halting construction of the 23-mile project in New Jersey state waters.
- Senior U.S. Circuit Judge Jane Richards Roth ruled the New Jersey Department of Environmental Protection acted in an "arbitrary and capricious" way by failing to adequately explain how the project complies with state water quality standards.
- Environmental groups, including the Natural Resources Defense Council , successfully challenged the certification, arguing the project would disturb seabed toxins like arsenic and PCBs while threatening marine habitats in the Raritan Bay.
- Responding to the ruling, Williams spokesperson Cherice Corley said the company is reviewing the decision and remains committed to the project, claiming it "remains critical to strengthening energy reliability and meeting the region's growing energy demand."
- With the case remanded to the NJDEP, the agency may supplement its explanation or issue a revised certification, though the court's ruling makes it illegal for Williams to begin construction without valid state certification.
