- Justice Department attorney Matthew Zorn argued for vacating the order, telling the court, "We're asking the court to vacate the order on the appointments so that the secretary can reconstitute the committee and get it back to work."
- Chief US Circuit Judge David Barron questioned the legal justification for the block, while lawyer Andrew Pincus urged the court to maintain it, claiming it provides "important protection for America's public health."
- The Advisory Committee on Immunization Practices has not met since the ruling, canceling two sessions; an upcoming meeting scheduled for October 21-23 faces potential cancellation if the committee is not reconstituted.
