US appeals court revives hundreds of private lawsuits linking Tylenol to autism
The panel said a judge wrongly excluded expert testimony, sending the cases back for further proceedings as plaintiffs press autism and ADHD claims.
A federal appeals court has reinstated over 500 private lawsuits against Tylenol maker Kenvue, breathing new life into claims that prenatal exposure to acetaminophen causes autism and ADHD.
The 2nd U.S. Circuit Court of Appeals ruled the lower court overstepped its gatekeeping role, finding that U.S. District Judge Denise Cote improperly excluded qualified expert testimony on a complex, contested scientific topic.
The ruling sent the cases back to federal court in Manhattan for further review, though the panel made clear it was not deciding whether Tylenol actually causes neurodevelopmental disorders.
Kenvue maintains that extensive scientific research shows Tylenol is safe for pregnant women, supported by medical organizations and the FDA, which does not mandate specific autism or ADHD warnings on the drug.
The legal reversal introduces major financial uncertainty for Kenvue, causing its stock to drop following the news, particularly as the company prepares to be acquired by Kimberly-Clark in a $40 billion deal.
