With a vote of 7 to 1, the Constitutional Court endorsed the majority of the articles of the pension reform of Gustavo Petro’s government, but asked the House to discuss, within 30 days, nine specific proposals and a new article. The Plena Chamber endorsed most of Law 2381 of 2024 and maintained the structure of the new pension system. However, there is a pending procedure in the House of Representatives.
The High Court will then have to review these points again, while the other provisions declared enforceable are due to enter into force on 1 April 2027.
The Constitutional Court returned ten cases of Petro’s pension reform to the House of Representatives so that the plenary would debate them, after finding that proposals were left without voting in the process of pension reform. Judgment C-264 of 2026 set the corporation a deadline of 30 working days from the notification of the ruling.
