Headteachers' union considering industrial action after losing High Court bid against Ofsted

NAHT plans member consultation on industrial action after court upheld Ofsted's multi-category school grading, amid concerns over staff wellbeing and a new framework launching Nov 10.

  • On Monday, the National Association of Head Teachers said it will consult members on possible industrial action after the High Court dismissed its bid, with Mr Justice Saini refusing permission and Ofsted preparing to implement report cards on 10 November.
  • Barristers for the NAHT argued the consultation ruled out narrative-only verdicts and said the new scheme neglected staff wellbeing, following Ofsted's consultation launched this year after Ruth Perry's death.
  • In his ruling, Mr Justice Saini stated `It is for Ofsted to decide how to conduct its inspections in the way which, in its expert judgment, is most effective, while taking account of the risk to the wellbeing of teaching staff and leaders.`, and Sir Martyn Oliver was pleased with the outcome.
  • Ofsted said inspections can begin this month and the new reports will give parents more detailed information, while Sir James Eadie KC called the union's claim 'weak' and the scheme a considerable wellbeing upgrade.
  • Nearly 2,000 school leaders have raised concerns and urged action, the National Education Union and Association of School and College Leaders backed the legal challenge, and schools will receive five grades across six areas after inspections paused since September 1.
