Trump-appointed judge joins ruling against migrant detention policy
The 2-1 ruling could affect millions of migrants who have lived in the U.S. for years, the court said.
- On Thursday, the San Francisco-based 9th U.S. Circuit Court of Appeals ruled 2-1 that the Trump administration cannot deny bond hearings to migrants detained within the United States, marking the administration's fifth consecutive appellate loss.
- The administration issued guidance last July expanding mandatory detention, previously reserved for border arrests, to immigrants living in the U.S. interior, arguing a 1996 law authorizes detaining migrants without bond hearings.
- Federal judges have overwhelmingly rejected this interpretation, with 460 judges ruling against the policy in more than 10,000 cases, while only 54 judges supported the administration in about 1,100 cases across all circuits.
- The U.S. Department of Homeland Security stated it "strongly disagrees" with the 9th Circuit panel, and Secretary Markwayne Mullin affirmed the administration is enforcing the law "as it was actually written to keep America safe."
