- On Monday, the Trump administration asked the Supreme Court to block a lower court order and allow the Federal Bureau of Prisons to enforce a policy restricting medical interventions and social accommodations for transgender inmates.
- Adopted in February 2026 to implement an executive order signed by President Trump, the policy prohibits transgender inmates from obtaining gender-transition surgeries, hormone therapy, and "social accommodations," such as wigs and padding.
- Ruling the policy was "reverse engineered" to satisfy the executive order, Senior District Judge Royce Lamberth blocked the rules; the Columbia Circuit Court of Appeals also declined to restore them earlier this month.
- Warning that the order "interferes with" prison administrators' "expert judgment," Solicitor General D. John Sauer argued the lower court is "substituting its own policy judgment for that of the agency."
- Vowing to fight the appeal, lawyers with the American Civil Liberties Union and Transgender Law Center contest the case as it reaches the 6-3 conservative Supreme Court amid ongoing legal setbacks for LGBTQ Americans.
