Timothy Busfield Seeks to Have Grand Jury Indictment Dismissed
Busfield’s lawyers say prosecutors withheld favorable evidence and misstated the law to the grand jury, which they argue tainted the four-count indictment.
On Thursday, June 18, actor Timothy Busfield filed a motion in New Mexico court to quash his grand jury indictment, arguing prosecutors did not present a fair case and misstated the law to jurors.
Busfield faces four counts of criminal sexual contact with a child stemming from alleged incidents involving two twin boys on the set of 'The Cleaning Lady' between late 2022 and early 2024.
Citing prosecutorial misconduct, the defense motion claims the state abdicated its role by suppressing exculpatory evidence, including a Warner Bros. investigation and a lie detector test Busfield allegedly passed.
A status hearing is scheduled for Tuesday, June 30, while the court has not yet ruled on the motion to dismiss the indictment against the 69-year-old actor.
Supported by his wife, actress Melissa Gilbert, Busfield continues to maintain his innocence as legal proceedings move toward trial scheduled to begin in May 2027.
