Becky Hill Asks Federal Court to Drop Alex Murdaugh Lawsuit Against Her
Hill argues Murdaugh cannot recover defense fees under federal civil rights law and says nearly $435,000 was spent before the alleged misconduct began.
On Thursday, former Colleton County Clerk Becky Hill filed a motion to dismiss the federal lawsuit brought by Alex Murdaugh, who alleges she violated his Sixth Amendment right to an impartial jury during his 2023 murder trial.
Murdaugh sued for $600,000 in May, claiming Hill interfered with the jury that convicted him; the South Carolina Supreme Court subsequently overturned his conviction and remanded the case for a retrial.
Denying allegations of jury tampering, Hill's attorneys argued for dismissal based on Eleventh Amendment immunity and claimed she is not a "person" subject to suit under Section 1983.
The filing contends the claim is not "ripe" because the retrial has not occurred, and approximately $435,000 of the $600,000 in legal fees was spent before any alleged misconduct took place.
A federal judge will now consider the motion to dismiss, and if denied, Hill has requested a jury trial; Murdaugh awaits a status hearing scheduled for later this month.
