The Latest: Testimony concludes in pre-trial hearing in Charlie Kirk killing
Judge Tony Graf will decide whether prosecutors showed probable cause after five days of DNA, ballistics and witness testimony in the Charlie Kirk killing case.
- The preliminary hearing for Tyler Robinson, accused of killing activist Charlie Kirk, concluded Friday at Fourth District Court in Provo, Utah. Judge Tony Graf will rule on Sept. 1 whether sufficient evidence exists for trial.
- Forensic biologist Caitlin Oliver of the Bureau of Alcohol, Tobacco, Firearms and Explosives testified throughout the five-day hearing on DNA analysis. The state reported evidence was one trillion times more likely to have originated from Robinson than unrelated individuals.
- Oliver confirmed under cross-examination that DNA samples showed degradation and contamination from multiple people, including household members. She testified DNA presence does not prove who handled an item last, as it can transfer through simple contact.
- Judge Graf addressed a media error from Thursday when a camera briefly captured prohibited evidence. While denying the defense's request to remove electronic media, the judge ordered cameras must not capture evidence displayed in court.
- Robinson chose not to testify during the proceedings, following his attorney Kathryn Nester's advice. With the court adjourning Friday, the case's future now depends on Judge Graf's Sept. 1 ruling on prosecution evidence sufficiency.
