Tesla wins bid to revive UK lawsuit for 5G patents licence
The court said patent owners still must license standard-essential patents on fair terms, and Tesla’s separate bid to revoke three InterDigital patents can continue.

- Tesla originally sued in 2023 to determine licensing terms, but the High Court dismissed the request in 2024. The automaker unsuccessfully challenged that ruling at the Court of Appeal before escalating to the Supreme Court.
- The Supreme Court determined that patent owners cannot circumvent FRAND obligations by joining a licensing pool like Avanci. Tesla's separate claim to revoke three InterDigital patents is also allowed to proceed.
- Following the decision, the case returns to the High Court for further proceedings. Laurie Fitzgerald, president of Avanci Vehicle, said, "We respectfully disagree with today's decision and continue to believe Tesla's claims are without merit."
- Technology lobbying group CCIA and the Motion Picture Association supported Tesla during the appeal, intervening to emphasize broader implications for how patent holders engage with licensing platforms in the United Kingdom.
