B.C. metal plant, Metro seek judicial review of air-quality decision
Metro Vancouver and Ebco say the appeal board overreached when it ordered a permit review and new testing rules for a South Surrey plant.
- Metro Vancouver and Ebco Metal Finishing LP are seeking a judicial review of the Environmental Appeal Board's March 27, 2026, decision concerning an air-emissions permit for a South Surrey galvanizing plant.
- Following 19 appeals from residents and non-profit societies, the permit authorized the annual discharge of 3.7 tonnes of contaminants to Metro Vancouver, prompting challenges over human health and environmental protection.
- In its decision, the EAB cited "significant deficiencies" in stack test methodology and found "further, better evidence to be necessary to address the questions of what emissions are being produced" while issuing "highly prescriptive directions."
- Metro and Ebco contend the directions were "issued without first providing the District Director with an opportunity to provide evidence and submissions on their content, in breach of the EAB's procedural fairness obligations."
- Both parties are seeking a stay on the EAB's requirements until the judicial review is decided, while respondents have 21 days from service of the petitions to file a response.
