They are not two different crimes, although they may seem to be. Pending hearing the arguments of the sentence that disqualifies the still general prosecutor of the State, and that will allow to know the reasons of the five judges of the court that have decided to convict him, the only thing that is known for certain is that the judgement applies a “reserved data disclosure offence” in article 417.1 of the Criminal Code.
