SC Allows Lalu Prasad Yadav to Raise Plea of Prior Sanction During Trial
The court let Lalu Prasad Yadav challenge prior sanction under Section 17A, while the CBI charge sheet names 77 others, including 38 job seekers.
- On Monday, The Supreme Court refused to quash the CBI FIR and chargesheet against Bihar Chief Minister Lalu Prasad Yadav in the land-for-jobs case, though permitting him to challenge Section 17A of the Prevention of Corruption Act during trial.
- The case involves Group D appointments in the West Central Zone of the Indian Railways in Jabalpur, Madhya Pradesh, where officials allege recruits gifted land parcels to Yadav's family members or associates in exchange for positions.
- A bench of Justices M M Sundresh and N Kotiswar Singh granted the 77-year-old RJD chief exemption from appearing before the trial court, while the CBI filed a detailed charge sheet against Yadav, his family, and 77 other persons including 38 job seekers.
- Justice Ravinder Dudeja noted Section 17A was introduced in 2018, whereas allegations date back to 2004-2009; the court was "persuaded" that permitting a belated challenge would defeat the "orderly administration of criminal justice."
- Previously, the Delhi High Court refused to quash the FIR in March, while the Enforcement Directorate granted bail to Yadav last year; seeking a stay, Yadav argued the FIR was lodged in 2022, marking a 14-year delay.
