Samantha Ruth Prabhu Wins Big in Bombay High Court: Unauthorised Use of Her Name, Image and Voice on AI Platforms Barred

The court ordered takedowns of AI-generated deepfakes and morphed content after finding an apparent violation of the actor’s personality and publicity rights.

  • The Bombay High Court granted Samantha Ruth Prabhu interim protection on Thursday, barring AI-generated platforms and digital media entities from using her name, image, or voice without permission. The court ordered removal of Unauthorised content featuring the actor.
  • Justice Madhav Jamdar found that Unauthorised AI-generated deepfakes and morphed content infringed Samantha's personality and publicity rights. The suit targets 18 defendants, including technology platforms and digital media companies, for disseminating content without her consent.
  • Samantha invoked Section 38B of the Copyright Act and the Constitution of India, arguing her personality rights and right to privacy were violated. She secured leave under Clause XII of the Letters Patent on 28 August, allowing the court to address non-resident defendants.
  • The court directed immediate removal of Unauthorised content and granted a John Doe order, a mechanism allowing legal action against infringers whose identities remain unknown. Samantha stated, "It is an Indian story reaching Indian homes."
  • This legal action protects Samantha's moral rights as a performer against future exploitation through AI-generated content. The Bombay High Court will hear the matter again on 10 December to evaluate permanent injunctions and damages.
