Retired judge reflects on Lindsay Clancy's defense, what comes next
The prosecution is expected to call three rebuttal witnesses as the defense and state battle over whether Clancy understood her actions, Barretto said.
On Friday, the prosecution began its rebuttal case in the Lindsay Clancy murder trial, challenging the defense's claim that she suffered from postpartum psychosis when she killed her three children in 2023.
Defense attorneys argue Clancy, 36, is not criminally responsible for the 2023 deaths, while prosecutors contend the former labor and delivery nurse planned the killings.
Psychologist Avram Mack testified as a rebuttal witness, disputing defense expert Resnick's assessment that Clancy was 'clearly psychotic' by finding no evidence of mania or psychosis.
Judge Jim Barretto described the trial as a 'pitched battle' over criminal responsibility, noting the defense may call one witness in final surrebuttal after the Commonwealth concludes, likely Monday.
Barretto stated, 'This is the week, and a little into next week, that frankly will decide this case,' as jurors weigh evidence from the Duxbury home where the children were found.
