Federal Class-Action Lawsuit Filed over Dowagiac Data Center Noise
The suit says the facility’s 24/7 noise affects about 1,300 nearby homes and has reduced residents’ use of their property.
- On Tuesday, Liddle Sheets P.C., a Detroit-based law firm, filed a federal class-action lawsuit against Alliance Cloud Services LLC in U.S. District Court for the Western District of Michigan, representing Dowagiac residents citing constant noise from the Hyperscale Data Center.
- Operating for four years, the Hyperscale Data Center generates a constant hum from cooling systems and fans that penetrates nearby homes, rendering yards unusable for residents like Lindy Valenzuela, one of the named plaintiffs.
- The complaint alleges that 1,300 residential properties within a mile of the facility are impacted, asserting that Alliance Cloud Services failed to implement adequate soundproofing equipment to prevent excessive noise emission beyond its property.
- Dowagiac Mayor Patrick Bakeman stated the city is not part of the litigation, while Alliance Cloud Services declined to respond to requests for comment regarding the allegations.
- As Hyperscale Data secures 48.5 acres to expand operations for artificial intelligence development, residents like Mitchell Gourley, a neighbor, hope the lawsuit compels the company to make adjustments or relocate to an industrial park.
