Phala Phala Impeachment Could Return to Parliament Even if Court Quashes Report

On Wednesday, President Cyril Ramaphosa appeared in the Western Cape High Court to challenge the Section 89 independent panel report, arguing it was flawed and based on untested evidence regarding the Phala Phala game farm theft.
The independent panel, headed by former Chief Justice Sandile Ngcobo, concluded Ramaphosa may have a case to answer regarding the theft of $580,000 from his Limpopo farm on 9 February 2020.
Advocate Wim Trengove argued the panel failed to conduct a "qualitative assessment" of whether the President acted "deliberately and in bad faith," a requirement essential for constitutional impeachment.
In opposition, Advocate Anton Katz, representing the African Transformation Movement and leader Vuyolwethu Zungula, argued Ramaphosa must wait until proceedings are finally decided in the National Assembly before challenging the report.
Should the impeachment process return to the National Assembly, the Government of National Unity coalition parties hold a majority of the 400 seats, potentially allowing them to vote down further proceedings.
