Quebec lawyers finding creative ways to reach potential opioid class-action members
Lawyers say about 1,400 people have signed up as they try to reach eligible claimants in shelters, jails and hospitals.
On Thursday, lawyer Olivia Wawin visited Montreal's Meta d'Ame harm reduction clinic to help register potential claimants for a class-action lawsuit against eight opioid manufacturers authorized by Quebec's Superior Court in 2024.
While some 13,000 people in Quebec have been treated for opioid addiction, only about 1,400 have registered for the lawsuit; community worker Christopher Kucyk noted those in the throes of addiction prioritize immediate survival over legal documentation.
Lead plaintiff Jean-François Bourassa filed the suit after opioid use wreaked havoc on his life, while lawyer Margo Siminovitch with law firm Fishman Flanz Meland Paquin LLP manages a $22 million settlement pool from previous company agreements.
The registration deadline is July 31, but Siminovitch is considering requesting a six-month court extension to allow more members to come forward and access necessary medical and pharmaceutical records.
This provincial action excludes OxyContin and OxyNEO, covered by a separate 2023 national settlement, and remains distinct from the ongoing Canada-wide class action against more than 40 manufacturers filed in British Columbia.
