Special NIA Court Rejects Bail Plea of Pulwama Terror Attack Accused Insha Jan
The court said 49 of 240 witnesses had been examined and found enough evidence to keep the accused in custody under the UAPA.
On Thursday, August 20, Special Judge Prem Sagar rejected the bail plea of Insha Jan, an accused in the 2019 Pulwama suicide attack that killed 40 CRPF personnel, finding sufficient material to presume accusations against her were prima facie true.
Alleging Jan harbored Jaish-e-Mohammed terrorists at her Harkipora home, the National Investigation Agency arrested her in March 2020 for allegedly facilitating logistics to Muhammad Umar Farooq and Mohd Kamran Ali.
Defense lawyers cited Jan's six-year incarceration and trial delays—only 49 of 240 prosecution witnesses examined—while Judge Sagar invoked Section 43-D of the Unlawful Activities Act, which bars bail when accusations are prima facie true.
Judge Sagar rejected health concerns and trial delays as bail grounds, stating, "If the applicant is released on bail, there is every likelihood that she will influence the key witnesses which might hamper the process of justice."
Clarifying that the bail rejection does not affect the ongoing criminal trial's merits, the court directed jail authorities to ensure Jan receives necessary medical care during her continued detention.
