This was the first time that the Council of State had decided on the new rules put in place by the Arcom, following a decision by the highest court of February 2024, which had made a great deal of noise.
The Council of State decided for the first time on the new rules of the Arcom, considering that the audiovisual regulator did not have to classify the interveners. A decision which is scandalous, while voices call for the instance to enforce pluralism on the public service.
On Friday, 4 July, the Council of State ruled that, in order to control pluralism, the Arcom did not have to classify each stakeholder but had to "appreciate the diversity of expressions in a global manner" on the air. The highest court thus rejected the request for finer control from four associations.
