Omaha Tribe of Nebraska becomes first in state to fully legalize cannabis

OMAHA RESERVATION, NEBRASKA, JUL 16 – The Omaha Tribe established a regulatory framework including adult-use sales, expungement of prior offenses, and a Cannabis Regulatory Commission to boost tribal revenue and social equity.

  • On Tuesday, the Omaha Tribe of Nebraska legalized medical and recreational cannabis, making it the first government in the state to do so and implementing the law immediately.
  • Motivated by funding needs, the Omaha Tribal Council pursued legalization, and tribal leaders aim to invest earnings in health, education, housing and infrastructure.
  • Under the Tribal Cannabis Control Code, regulators must set licensing, testing and seed-to-sale tracking rules, and create a Cannabis Regulatory Commission with three to five members.
  • Under the new law, prior tribal cannabis offenses can be expunged, and retail cannabis sales are permitted to adults 21 and older on reservation land.
  • Implementation kicks off in 2025 for licensing, compliance and public outreach, and patients can start making cannabis purchases early to mid 2026.
