New York Times Accuses Agency of Political Retaliation in Countersuit over Discrimination Case
The paper says the agency ignored its own investigation and filed the case in retaliation for reporting that criticized EEOC leadership.
- On Friday, The New York Times filed a countersuit against the Equal Employment Opportunity Commission, accusing the federal agency of political retaliation and free speech infringement in response to a discrimination lawsuit.
- The EEOC initiated the legal battle in May, alleging the Times violated civil rights laws by passing over white male employee Bryant Rousseau for a promotion awarded to a multiracial woman.
- Attorneys for the Times claim the eight-month investigation revealed "no evidence that race or sex was considered," arguing the lawsuit targets the organization for its critical reporting on the administration.
- The countersuit alleges the Commission "was filed by a Commission that has expressly disavowed any independence from the President" and pursued a bad-faith political agenda rather than merit-based claims.
- Seeking dismissal with prejudice, the Times argues the lawsuit violates the First and Fifth Amendments and the Administrative Procedure Act, claiming it poses a "uniquely insidious threat to a free and independent press.
