India Drafts New Social Security Code, Proposes 90-Day Work a Year for Gig Workers to Get Benefits
The draft rules require gig workers to complete 90 days of work with a platform to access benefits including health insurance and old-age protection, subject to stakeholder consultation.
- The Centre pre-published draft rules to create a designated registration portal and eligibility framework for social-security benefits for gig and platform workers, opening a consultation window for stakeholder comments.
- Absence of notified rules had delayed benefit rollout, leaving millions of workers without statutory protection, after the Code on Social Security formally recognised gig and platform workers.
- The draft sets a 90-day eligibility threshold for aggregator engagement; workers above 16 must register with Aadhaar, and aggregators must share verified data, with eligible workers receiving identity cards.
- The consultation is expected to precede final notification and state-level implementation, with platform companies warning of tracking challenges and worker unions cautioning the 90-day rule may exclude many, while experts said outcomes depend on portability, contributions and enforcement.
- The Ministry has already started registering gig workers on the e‑Shram portal, linking to Ayushman Bharat with future pension eligibility based on contributions.
