Nestle India faces FSSAI action over '5 HMOs', 'easy-to-digest' whey claims in baby food
- On Friday, the Food Safety and Standards Authority of India initiated legal action against Nestle India over alleged non-compliance involving its NAN Excella Pro Stage 1 and Lactogen Pro 1 infant nutrition products.
- According to FSSAI, both products violate Regulation 4 of the Food Safety and Standards Regulations, 2020. The regulator also cited Section 3 of the Infant Milk Substitutes, Feeding Bottles and Infant Foods Act, 1992, which prohibits their advertisement and promotion.
- FSSAI flagged promotional claims for NAN Excella Pro Stage 1 relating to "5 HMOs" and Whey Protein, while also questioning Lactogen Pro 1's claim that its Whey Protein was easy to digest.
- Separately, laboratory analysis found a follow-up formula manufactured by Nestle India did not conform to prescribed biotin requirements under the 2020 regulations. The sample was subsequently sent for re-analysis.
- Following the alleged violations, FSSAI filed 3 separate adjudication cases against Nestle India in relation to the products. The action covers promotional claim contraventions and laboratory findings concerning biotin content.
