Nebraskans for Medical Marijuana Criticize AG Hilgers over Federal Cannabis Lawsuit
Nebraska and two other states asked a federal court to block the move, while supporters say the change would not alter medical access.
- Last week, Nebraska Attorney General Mike Hilgers and his counterparts from Indiana and Louisiana filed a federal lawsuit in the D.C. Circuit challenging the Trump Justice Department's decision to reclassify marijuana from Schedule I to Schedule III.
- Historically, opponents used the Schedule I classification to dispute claims that cannabis has legitimate medical value, arguing that maintaining this status is necessary to prevent broader access.
- Crista Eggers, executive director of Nebraskans for Medical Marijuana, criticized Hilgers for utilizing taxpayer funds to oppose the will of voters who supported medical cannabis initiatives.
- Eggers said Hilgers is attempting to "keep that excuse alive" by litigating against the federal shift, noting that Nebraskans are effectively funding his opposition to reclassification.
- The anti-cannabis advocacy organization Smart Approaches to Marijuana also joined the petition, challenging the federal move to open research opportunities for cannabis that the DOJ considers a drug with moderate potential for dependence.
