More GOP Party Platforms Include Anti-IVF Language. Is Surrogacy Next?
Republican state parties in five states added anti-IVF language, while lawmakers and activists are now pushing new limits on surrogacy.
The Idaho Republican Party added language to its 2026 platform opposing "the destruction of human embryos," while the Texas Republican Party adopted a platform plank opposing public funding for IVF.
Following the 2024 Alabama Supreme Court ruling that declared embryos "unborn children," legislators in at least 17 states introduced 36 bills this year codifying embryonic "personhood" rights, according to the Guttmacher Institute.
Republicans in Congress have blocked legislation protecting IVF access, while U.S. Senator Rick Scott introduced a bill in November to prevent "adversarial nations" from hiring American surrogates, citing security concerns.
Idaho Democratic state representative Brooke Green, who used IVF and surrogacy to build her family, warns that rising opposition threatens access to these treatments for parents struggling to conceive.
Green anticipates that Idaho legislators will prioritize new restrictions on surrogacy in the 2027 session, as anti-abortion groups like Students for Life of America intensify their opposition to fertility treatments.
