Judge Sets Trial Date for Missouri Redistricting Referendum, Initiative Petition Amendment
The court says lower judges should act quickly because the case could determine whether the redistricting measure reaches voters this fall.
- On Monday, Missouri Supreme Court Chief Justice Brent Powell urged lower courts to expedite a lawsuit deciding whether a congressional redistricting referendum will appear on the Nov. 3 ballot.
- Secretary of State Denny Hoskins blocked a referendum petition containing more than 300,000 signatures on Aug. 4, arguing the Missouri Constitution prohibits referendums on redistricting plans pushed by Republicans under pressure from President Donald Trump.
- The political action committee People Not Politicians filed a lawsuit challenging the decision, arguing the constitution's silence permits a referendum. Through more than a dozen lawsuits, opponents have previously lost or been stymied questioning the map's legality.
- Cole County Circuit Judge Daniel Green set the first hearing for Wednesday morning, complying with Powell's directive to prioritize the case. Whatever Green decides, Powell wrote the case will likely be appealed.
- This lawsuit represents the final opportunity to overturn the gerrymandered redistricting plan before the Nov. 3 election. If the court upholds Hoskins' decision, the map passed to favor Republicans in the 5th Congressional District will remain in effect.
