On Thursday, Missouri Attorney General Catherine Hanaway filed a lawsuit against Relax Relief Rejuvenate Trading LLC, also known as EDP Kratom, for unlawfully selling kratom-derived opioid products, expanding her legal action following a March 31 suit against CBD American Shaman.
The Missouri Department of Health and Senior Services and Hanaway allege the companies sell products containing 7-hydroxymitragynine and MGM-15, which studies show is approximately 15 times more potent than morphine, despite an FDA warning to EDP Kratom last year.
State data submitted by Hanaway's office links synthetic 7-OH to at least 197 Missouri deaths, while her office cited claims the substance cuts fentanyl; American Shaman countered with expert affidavits disputing the public health risks.
Jackson County Circuit Judge Charles McKenzie denied the request for a temporary restraining order on Friday, citing "competing affidavits" from experts on both sides and ruling "without prejudice" to allow future reconsideration.
McKenzie ordered an additional hearing for May 11 to analyze the parties' positions and evidence, determining the court must fully develop the case before deciding if preliminary relief is warranted.
