Manhattan DWI Defense Attorney Rachel Kugel Explains Field Sobriety Tests and Legal Rights in New York
Drivers suspected of impaired driving in New York may be asked to perform field sobriety tests, but these tests are not required by law and their results can be challenged in court.
The National Highway Traffic Safety Administration created three standardized field sobriety tests: Horizontal Gaze Nystagmus, Walk-and-Turn, and One-Leg Stand.
Attorney Rachel Kugel states that these tests are designed for ideal conditions which rarely exist during roadside stops, affecting their accuracy.
After a DWI arrest, contacting an attorney promptly is the most important step regardless of whether field sobriety tests were taken.
