Man sues ICE over email investigation
The lawsuit says agents left a warning notice, made calls and visited his home after he emailed criticism of an ICE official.
- On Monday, New York resident David Streever filed a lawsuit against the Department of Homeland Security, alleging agents violated his First Amendment rights by delivering a warning notice regarding a critical email sent in January.
- Streever sent the email to then-acting ICE Director Todd Lyons criticizing the agency's response to a Minnesota shooting, comparing Lyons to a Nazi official and predicting he would "torment yourself until your last day on Earth."
- While Streever traveled in Finland, federal agents tracked him to a New York City hotel to confront him; attorneys with the Foundation for Individual Rights and Expression argue the actions were designed to "systemically chill ICE's critics."
- A DHS spokesperson denied attempting to "squash" free speech, asserting the agency investigates credible threats against employees and noting officers face an 8,000% increase in death threats.
- Similar encounters occurred with other critics, including a poll worker in Central New York, as Streever seeks a preliminary injunction in U.S. District Court to block further retaliation while his lawsuit proceeds.
