- After Cavazos walked away from the fight, Gutierrez allegedly pulled a handgun and shot him three or four times in the back from about 10 feet away. Later, Gutierrez wrote, "I did not want to kill him but I didn't want him to kill me."
- The following day, Gutierrez surrendered at a police station in downtown Albuquerque. Investigators said he later messaged a relative on Snapchat, asking, "Is he really dead?"
- Investigators recovered a handgun belonging to Cavazos roughly 10 yards from his body at the Copper Hills apartment complex, though witnesses stated he did not have the weapon drawn. The discovery may complicate Gutierrez's self-defense claim.
