- Plaintiffs allege the Service violated the National Wildlife Refuge System Improvement Act of 1997, stating the lawsuit claims the Service prioritized giving SpaceX refuge land over enforcing protections.
- Although the Service claimed the exchange provides a "net conservation benefit," Juan Mancias of the Carrizo/Comecrudo Nation of Texas stated the land is sacred and the transfer continues tribal erasure.
- The lawsuit asks a federal court in Washington to halt the exchange, which the agency approved earlier this month following internal planning that began in April 2025.
