Judge reinstates credit union agency members fired by Trump
UNITED STATES, JUL 23 – Judge rules Trump unlawfully fired NCUA board members, ordering their reinstatement to protect the agency's independence for 143 million Americans relying on credit unions.
- On Tuesday, U.S. District Judge Amir Ali ordered the reinstatement of Todd Harper and Tanya Otsuka, who were fired in April by President Donald Trump, in Washington, D.C.
- Under the Federal Credit Union Act , U.S. District Judge Amir Ali wrote that Congress restricted the President's authority to fire NCUA Board members, implying limits on presidential removal power.
- With only one board member, the NCUA's decision-making stalled, while Tanya Otsuka said in an emailed statement that `I look forward to getting back to work to make sure we have a safe and resilient financial system`.
- Meanwhile, the Trump administration appealed the order, and the U.S. Court of Appeals for the D.C. Circuit paused the ruling pending further review.
- Long-Standing precedent from Humphrey’s Executor shields independent agency heads from removal without cause, Trump’s removal tactics have teed up the high court to revisit that precedent, suggesting future legal review.
