- Cannon said a June 2023 protective order prevents disclosure of discovery materials, citing that `disclosure of non-public discovery material... would contravene basic notions of fairness and justice` and that Smith was unlawfully appointed.
- Compiled from voluminous discovery, the report included 137 pages of detailed evidence and was finalized before the DOJ departure in January 2025.
- The order bars the Department of Justice from sharing Volume II externally, including with U.S. Congress, and prevents public disclosure of substantial case details, risking grand jury secrecy and defendants' presumption of innocence.
- Against that backdrop, First Amendment groups pressed for release while Smith defended his investigation, saying `Our investigation developed proof beyond a reasonable doubt that President Trump engaged in a criminal scheme to overturn the results of the 2020 presidential election and to prevent the lawful transfer of power`.
