- At a March 18 hearing, immigration judge Charles R. Conroy ordered Rafael Rubio, a City Council data analyst, deported after his Jan. 12 arrest at an asylum appointment in Bethpage.
- Disputes over Temporary Protected Status prompted Conroy to question Rubio's claim of protected status at a Feb. 26, 2026 hearing after DHS terminated TPS for Venezuelans last October.
- On Wednesday, Menin said, 'Today, in immigration court, Judge Conroy deemed Rafael's asylum application, quote unquote, 'abandoned' based on a technical issue related to a missing signature' and that 'the judge refused to allow the issue to be corrected.'
- Rubio remains in ICE custody after being denied bond and is held at the Metropolitan Detention Center, Brooklyn while a habeas corpus proceeding in Manhattan federal court proceeds.
- According to the Department of Homeland Security, Rafael Rubio overstayed a 2017 tourist visa, was arrested for assault, and lacks work authorization, while City Council officials and allies say he was authorized and are engaging Congress and New York officials to fight the order.
