Deadline to Claim COVID-Era IRS Penalty Refunds Is Friday
The new online tool lets taxpayers file COVID-related refund claims before the July 10 deadline, which experts say could affect millions.
The IRS added an online filing tool for Form 843 on July 1, allowing individual taxpayers to submit protective refund claims related to Kwong v. United States before the July 10, 2026, deadline.
Federal tax deadlines were automatically suspended during the COVID-19 disaster period from January 20, 2020, through May 11, 2023, plus 60 days, according to a judge's ruling in Kwong v. United States.
Individual taxpayers with an IRS Online Account can file electronically for claims involving fully paid penalties and interest, while business taxpayers must still submit Form 843 via paper.
Independent National Taxpayer Advocate Erin Collins urges taxpayers to review records immediately, cautioning that "filing a claim does not guarantee relief" while the legal issue remains unsettled.
The government has appealed the Kwong ruling, with a brief due by July 20, 2026; if the decision stands, millions could receive refunds, but those missing the July 10 deadline lose eligibility.
