Indiana Attorney General Sues the Trump Administration over Marijuana Reclassification
Indiana and two other states say the Justice Department skipped required procedures in the marijuana reclassification and seek to vacate the rule.
Indiana Attorney General Todd Rokita filed a lawsuit in the District of Columbia Circuit on May 22, challenging the federal government's reclassification of marijuana, claiming the Department of Justice and DEA bypassed proper procedures.
The Trump Administration announced on April 23 that it would reclassify marijuana to Schedule III to expand medical access, though Rokita opposed the move in December alongside other state attorneys general.
On Wednesday, the court consolidated Rokita's complaint with a separate lawsuit filed earlier this month by Smart Approaches to Marijuana and the National Drug and Alcohol Screening Association .
SAM CEO Kevin Sabet welcomed the legal challenges, stating the coalition recognizes the order will cause "significant harm to public health and safety," while Rokita's office prioritized protecting "Hoosier families."
State Rep. Jim Lucas plans to pursue marijuana reforms in the 2027 session, arguing it is "time that the state of Indiana stopped criminalizing Hoosiers," while Gov. Mike Braun has signaled openness to reviewing legalization proposals.
