ICE Detention Center to Pay $100K Settlement in Landmark California Case
The company will improve disease-control plans and stop contesting a ruling that immigrant detainees are covered by state labor law.
The Florida-based GEO Group settled a landmark case with California regulators this week, agreeing to pay more than $100,000 and draft disease control plans for 12 detention facilities.
California Division of Occupational Safety and Health levied $104,510 in fines against the GEO Group in 2023, citing six violations after detainees reported lacking proper training and protective gear while cleaning for $1 per day.
Early last year, the Occupational Safety and Health Appeals Board ruled that detainees participating in work programs qualify as 'affected employees' entitled to workplace safety protections under California law.
GEO withdrew its legal challenges as part of the agreement, committing to draft aerosol transmission plans for 12 secure facilities and ensure detainees receive necessary personal protective equipment.
New federal standards released last month by U.S. Immigration and Customs Enforcement claim detainees are not employees, a position Attorney Mariel Villarreal suggested may reflect GEO Group strategy in response to state enforcement.
