- Because Khan had represented the Philippines Human Rights Commission, Duterte's defence argued his involvement with victims' communications created a conflict undermining impartiality.
- Khan previously stepped aside in May amid a U.N. inquiry into alleged sexual misconduct, and Khan's attorneys have denied the allegations while he argued there was "no conflict of interest".
- He has been barred from taking part in the Duterte prosecution, the court's only major active case, while deputy prosecutor Mame Mandiaye Niang now handles it amid sanctions by Washington.
- Beyond the Philippines, the ICC has also issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former defence chief Yoav Gallant last November, situating Duterte’s March arrest at The Hague within wider investigations.
