Sonam Raghuvanshi Case: SC Mulls Larger Bench Reference in Meghalaya Honeymoon Murder Case
The bench may refer the case to a larger panel as it weighs whether a clerical error in arrest papers can override a bail order.
- On Thursday, The Supreme Court began reviewing whether a typographical error in an arrest memo—citing the wrong section of the Bharatiya Nyaya Sanhita —invalidates bail for Sonam Raghuvanshi in her husband's murder case.
- Sonam Raghuvanshi was arrested in June 2025 after her husband, Raja Raghuvanshi, was found dead in a deep gorge in Meghalaya's Sohra area while the couple vacationed there. Police allege she conspired with hired assailants for financial gain.
- The Meghalaya High Court upheld bail on June 29, citing the arrest memo's 'total non-application of judicious mind' because it cited Section 403 instead of Section 103 of the BNS. Solicitor General Tushar Mehta argues the error was purely clerical.
- Justices Manoj Misra and Shree Chandrashekhar indicated The Bench may refer the legal question to a larger Bench to resolve conflicting judgments on whether written arrest grounds must be provided at detention. "We will consider this matter at length," Justice Misra said.
- The Bench directed State Police to provide legible photocopies of original arrest documents to verify what information was communicated to Raghuvanshi. Justice Misra cautioned, "If this ground is not sustainable, then the bail order goes.
