How Trump’s SAVE America Act could make it harder for married women to vote
The measure would require a birth certificate or passport for most voters and could force millions of women to gather extra records, analysts said.
- President Donald Trump's SAVE America Act would mandate that most Americans show a birth certificate or passport to register to vote, potentially affecting millions of women seeking to prove their citizenship.
- Eighty-Four percent of women in opposite-sex marriages take their husband's last name or hyphenate, according to a 2023 Pew Research Center survey, creating a mismatch between birth certificates and current legal names.
- As many as 69 million American women have birth certificates that do not match their current name, according to the Center for American Progress; Tracy Thomas, a constitutional law professor at the University of Akron School of Law in Ohio, said opponents could argue this amounts to voting discrimination violating the 14th Amendment.
- Alison Gill, director of nominations and democracy at the National Women's Law Center, said election officials face criminal liability for registering individuals with mismatching documents, placing the burden on officials to decide whether to risk registration.
- White House press secretary Karoline Leavitt denied the claims in March, stating there was "zero validity" to reports that the legislation would make it harder for women to vote, while Florida, Mississippi, South Dakota, and Utah have enacted similar proof-of-citizenship measures this year.
